Terms of service

Version 0.2 · Aug 31, 2026

1. GENERAL 1.1. These General Terms and Conditions apply to the use of Steadia, a service of LoreVault, hereinafter referred to as: "Steadia". 1.2. Steadia provides services for monitoring websites, including availability checks, notifications in the event of outages, SSL and domain expiration checks, keyword checks, broken link checks, status pages and SEO reports. 1.3. By taking out a subscription or using Steadia, the customer agrees to these General Terms and Conditions. 1.4. Steadia reserves the right to amend these General Terms and Conditions. The customer will be informed by email of any changes and the date on which such changes will take effect. If a change is materially detrimental to the customer, the customer will have the opportunity to cancel the subscription before the effective date of the change. To the extent that the law prescribes a different procedure or additional rights, those statutory rights remain fully applicable. 2. STEADIA DETAILS Trade name: Steadia, a service of LoreVault Address: Vogelenzanglaan 2, 3208 AT Spijkenisse, The Netherlands (No visitor address) Email: info@steadia.nl Chamber of Commerce number: 94812349 VAT number: NL005110246B21 3. THE SERVICE 3.1. Availability Monitoring 3.1.1. Steadia checks the URL provided by the customer from Steadia's infrastructure. 3.1.2. A timeout of 10 seconds applies to each check. Redirects may be followed. 3.1.3. A website is only considered unreachable after two consecutive checks have failed. 3.1.4. In addition to the HTTP status code, Steadia may check the content of a web page for known error messages, including technical error indicators such as "There has been a critical error on this website", "Fatal error:", "Uncaught Error" and "Parse error:". 3.1.5. If an outage is detected, Steadia may record the start time, end time and duration of the outage and send a notification. A notification may be sent again when the service is restored. 3.1.6. Consistently slow responses may be reported separately. Slowness is not automatically considered an outage and does not count towards any uptime percentage. 3.1.7. The monitoring frequency depends on the selected subscription and the user's settings: * Free: at most once every 24 hours; * Starter: at most every 30 minutes; * Pro: at most approximately every minute; * Agency: at most approximately every minute. 3.1.8. The stated monitoring frequencies are target intervals and do not constitute a guarantee. Checks may be performed later or may be missed due to technical circumstances, queues, maintenance, overload, network problems or other circumstances. 3.2. SSL and Domain Expiration 3.2.1. Steadia may check the validity of SSL certificates and domain names. 3.2.2. For SSL certificates, a warning may be sent when the certificate expires within 14 days. 3.2.3. For domain names, a warning may be sent when the domain name expires within 30 days. 3.2.4. Reminders may be sent at most once every 7 days per website. 3.3. Keyword Monitoring 3.3.1. The customer may configure a text fragment per website that must be present on a page or must not be present. 3.3.2. If Steadia detects a deviation, a notification may be sent. 3.4. Broken Link Monitoring 3.4.1. Steadia may crawl websites and check links for availability. 3.4.2. Only newly detected broken links may result in a notification. 3.4.3. The number of pages checked during a scan depends on the selected plan. 3.5. Status Page 3.5.1. A public status page may be made available for a website within Steadia's domain. 3.5.2. A status page may display, among other things, the current status, the time of the last check and information about response times. 3.5.3. The customer may enable or disable the status page per website. 3.6. SEO Reports 3.6.1. SEO reports may be generated separately using SEO credits. 3.6.2. An SEO report may cover, among other things, titles, meta descriptions, headings, images, canonical tags, robots settings, mobile-friendliness, structured data, internal and external links and an optionally specified focus keyword. 3.6.3. SEO reports may be exported to formats including PDF and CSV and may be compared with a previous report. 3.6.4. A full scan is limited to a maximum of 500 pages. Websites with more than 500 pages will not be scanned in full. The actual scope of a scan may also be smaller if pages are inaccessible or cannot be processed for other technical reasons. 3.6.5. An SEO report is a technical snapshot and does not constitute a guarantee of improved search results, higher search engine rankings, increased traffic or any other SEO result. 3.7. Notifications 3.7.1. Notifications are generally sent by email to the account holder. 3.7.2. The customer may, if the functionality is available, configure additional email addresses. 3.7.3. Steadia may also send periodic summaries. 4. LIMITATIONS OF THE SERVICE 4.1. Steadia is a monitoring and notification service. Steadia does not repair websites, servers, databases, applications or other technical problems belonging to the customer. 4.2. The customer remains responsible for resolving detected problems. 4.3. Steadia does not create backups of websites and does not retain a complete copy of websites monitored by the customer. 4.4. Checks are performed from Steadia's infrastructure. Problems with Steadia's infrastructure, internet connections, hosting providers, DNS services, networks, websites or other third-party systems may result in a check not being performed, not being performed in a timely manner or producing an incorrect result. 4.5. Monitoring frequencies are target intervals and are not guaranteed intervals. 4.6. Steadia is an automated tool and is not a human check or a replacement for one. The customer may not assume that every outage, downtime or deviation will always be detected or reported immediately. 4.7. The available scans and checks are limited to the scope and frequency of the selected subscription. Pages, links or other components outside these limits are not checked. 5. SUBSCRIPTIONS AND PRICES 5.1. Stated subscription prices include VAT unless a different VAT treatment applies to a specific customer or transaction by law. 5.2. Steadia may change its prices. Customers affected by a price change will be informed in advance of the new price and the date on which it will take effect. 5.3. If the customer does not agree to a price increase, the customer may cancel the subscription before the effective date of the new price. If the customer does not cancel, the subscription will continue at the new price from the announced date. 6. PAYMENT AND RENEWAL 6.1. Payments are processed through the payment service provider designated by Steadia. Payment details such as card details and bank account numbers are not stored by Steadia itself when they are processed directly by the payment service provider. 6.2. When taking out a paid subscription, the customer authorizes automatic payment per month or per year, depending on the selected subscription period. 6.3. A subscription is automatically renewed until the customer cancels the subscription. 6.4. There is no minimum subscription term unless explicitly stated otherwise for a specific offer. 6.5. If a payment fails, the customer may settle the outstanding payment again. 6.6. If payment is not made on time and the relevant subscription period ends, the paid subscription will be terminated and access to the paid subscription features will be denied. The account will then be downgraded to the Free plan. 6.7. When an account is downgraded to the Free plan, the data and history contained in the account will remain available insofar as they are retained in accordance with Steadia's retention periods. The features and limits of the Free plan will apply from that point onward. 6.8. To the extent permitted by law, Steadia may charge the customer reasonable costs arising from an unpaid invoice or necessary collection measures. 7. CHANGES AND CANCELLATION 7.1. An upgrade to a higher subscription takes effect immediately. The higher limits and features become available from that moment. 7.2. A downgrade to a lower subscription takes effect at the end of the current billing period. 7.3. When downgrading, the site limit of the target plan applies immediately, meaning that no new websites may be added above the limit of the target plan. 7.4. If the customer has more websites at the time of a downgrade than are permitted under the new subscription, excess websites may be automatically paused. Websites will not be deleted and their associated history will remain stored. 7.5. Following a subsequent upgrade, previously automatically paused websites may be reactivated. 7.6. Cancellation of a paid subscription is processed as a downgrade to the Free plan and takes effect at the end of the already-paid subscription period. 7.7. No refunds are provided in the event of an interim cancellation or downgrade. The customer retains access to the paid features until the end of the already-paid period. 7.8. The customer may cancel a subscription through the functionality provided for this purpose within Steadia. 8. SEO CREDITS 8.1. Purchased SEO credits are valid for 12 months from the date of purchase. After this period expires, the relevant credits will expire. 8.2. SEO credits included as part of a subscription are granted periodically according to the selected subscription and are always valid for only 1 month. 8.3. When credits are used, the credits that expire first are used first. 8.4. If an SEO report cannot be generated due to a demonstrable technical error on Steadia's side, the credits used for that report will be refunded. 8.5. SEO credits cannot be exchanged for money and are non-transferable. 8.6. Upon termination of a subscription, previously purchased and unexpired SEO credits will remain available. These credits retain their original expiration date and remain valid for a maximum of 12 months from the original purchase date. 8.7. Any unused periodic SEO credits granted solely as part of a subscription will not be paid out in cash upon termination of the subscription. 9. RIGHT OF WITHDRAWAL 9.1. To the extent that the customer is a consumer, the customer may, in principle, exercise the statutory 14-day right of withdrawal for a distance contract, unless a statutory exception applies. 9.2. If the customer expressly requests that delivery of the digital service begin during the withdrawal period, the customer will be informed of this and, to the extent legally required and permitted, the legally prescribed consent or acknowledgement will be requested. 9.3. The manner in which the right of withdrawal and the request for immediate delivery are recorded may be registered by Steadia, including the date and time of consent and the version of the terms and conditions applicable at that time. 9.4. The statutory rules concerning the right of withdrawal remain decisive if these General Terms and Conditions conflict with those rules. 10. VAT 10.1. Prices are displayed including VAT unless otherwise stated. 10.2. For business customers within the European Union with a valid VAT number, VAT may be reverse-charged if the statutory conditions are met. 10.3. Steadia may verify VAT numbers through available European systems. 10.4. The VAT treatment of customers outside the Netherlands or outside the European Union will be determined in accordance with the tax legislation applicable at that time. 11. DATA AND RETENTION PERIODS 11.1. Individual monitoring results are retained for a maximum of 90 days and are then automatically deleted, unless a legal basis requires a longer retention period. 11.2. Outage overviews may be retained for longer periods for administrative, technical, statistical or legal purposes. 11.3. Invoices and administrative records are retained for as long as legally required, including the statutory retention period of seven years for tax records. 11.4. If the customer deletes their account, data that is no longer required will be deleted in accordance with the applicable retention periods. Data subject to a statutory retention obligation cannot be deleted immediately. 11.5. The processing of personal data is further described in Steadia's separate privacy statement. 12. AVAILABILITY AND NOTIFICATIONS 12.1. Steadia strives to keep its own services stable and available but does not guarantee that Steadia will be available at all times or that every check will be performed without interruption. 12.2. Steadia will make every effort to keep its own infrastructure available. However, outages, maintenance, network problems, software problems, overload, problems at hosting or infrastructure providers and other circumstances may cause the service to be temporarily or partially unavailable. 12.3. Steadia does not guarantee that a notification will be sent for every outage of a monitored website. 12.4. A missed notification may, among other things, result from an outage within Steadia, a problem in the network between Steadia and the monitored website, an outage at the website itself, incorrect or changed DNS settings, blocked traffic or other circumstances beyond Steadia's control. 12.5. The monitoring service is a tool and is not a substitute for human monitoring. The customer remains responsible for monitoring and managing the availability and operation of their websites. 12.6. Failure to receive a notification does not mean that a website was reachable at that time or that Steadia determined that no outage existed. 13. LIABILITY 13.1. Steadia is not liable for damage arising because an outage, error, deviation or downtime of a website was not reported, was reported late or was reported incorrectly. 13.2. In particular, Steadia is not liable for missed downtime notifications, regardless of whether the missed notification was caused by an outage in Steadia's infrastructure, a network problem, a problem at a third party or another technical cause. 13.3. Steadia is not liable for indirect damage, consequential damage, loss of turnover, loss of profits, missed savings, reputational damage, loss of customers or other indirect financial damage, insofar as such exclusion is permitted by law. 13.4. To the extent that Steadia is nevertheless liable for direct damage despite the provisions of these terms and conditions, liability is limited to the amount the customer paid for the relevant service during the twelve months preceding the event giving rise to the liability, with an absolute maximum equal to the amount paid for the relevant subscription period, unless a statutory provision does not permit such limitation. 13.5. The limitations of liability do not apply to the extent that the damage results from intent or deliberate recklessness on the part of Steadia or to the extent that a limitation is not legally permitted. 13.6. The customer remains responsible for making backups, securing websites and systems and promptly resolving problems reported by Steadia. 14. FAIR USE 14.1. The Agency subscription is intended for normal and reasonable use within the purpose for which the service is offered. 14.2. Steadia may take additional measures if a customer's use of the service is so extensive or intensive that it may disrupt the stability, availability, performance or normal use of Steadia for other customers. 14.3. In such a situation, Steadia may contact the customer to discuss the use and, where reasonably necessary, take appropriate measures. 14.4. Excessive use does not automatically result in termination or blocking. The fair-use policy is intended to address excessive use that actually places a burden on or disrupts the service. 15. PERMITTED USE AND RESPONSIBILITY FOR WEBSITES 15.1. Steadia does not actively verify whether the customer is the owner of a website added to the service. 15.2. The customer is responsible for having the necessary permission to have a website monitored, crawled or otherwise accessed by Steadia. 15.3. The customer may not use Steadia for websites or systems for which they do not have lawful authorization to have automated requests, checks or scans performed. 15.4. To the extent permitted by law, the customer indemnifies Steadia against third-party claims arising from the absence of the required permission to monitor, crawl or check a website provided by the customer. 15.5. Steadia may remove or pause a website or restrict checks if it reasonably appears that its use violates these terms and conditions, applicable law or the interests of the service. 16. INTELLECTUAL PROPERTY 16.1. All rights to the software, infrastructure, user interface, design, reporting structure and other components of Steadia that are not expressly granted to the customer remain with Steadia or its licensors. 16.2. The customer is granted only a limited, personal and non-transferable right of use for the duration of the subscription, insofar as necessary to use Steadia. 16.3. It is not permitted to copy, reproduce, sell, resell, distribute, reverse-engineer or otherwise exploit Steadia, in whole or in part, unless permitted by law or Steadia has given prior written permission. 17. TERMINATION OF THE SERVICE 17.1. Steadia may terminate or temporarily restrict a subscription if the customer seriously or repeatedly violates these terms and conditions, applicable law or payment obligations. 17.2. If termination is necessary due to abuse, fraud, unlawful use, security risks or another serious reason, Steadia may immediately restrict access to the extent reasonable and legally permitted. 17.3. If termination occurs due to failure to pay a subscription on time, the account will, in accordance with Article 6, be downgraded to the Free plan once the paid period has expired. 18. CHANGES TO THE SERVICE 18.1. Steadia may modify, improve, expand or discontinue parts of the service. 18.2. Steadia will make reasonable efforts to inform customers in a timely manner about changes that materially affect the use of the service. 18.3. No right to compensation may be derived from technical changes necessary for security, maintenance, stability or compliance with laws and regulations, to the extent permitted by law. 18.4. Steadia does not guarantee that every feature or technical implementation will remain permanently available without changes. 19. FORCE MAJEURE 19.1. Steadia is not required to fulfil any obligation if fulfilment is prevented by circumstances beyond its reasonable control. 19.2. Force majeure may include, among other things: outages at hosting or infrastructure providers, network outages, internet outages, outages at DNS or external services, power outages, cyberattacks, government measures, natural disasters, fire, war, strikes and other circumstances over which Steadia can reasonably exercise no control. 19.3. If a force majeure situation continues for an extended period, Steadia and the customer will consult with each other regarding the further performance of the agreement. 20. FINAL PROVISIONS 20.1. If any provision of these General Terms and Conditions proves to be void or voidable, the remaining provisions will remain fully in force. 20.2. In such a case, the parties will attempt to replace the relevant provision with a legally valid provision that most closely reflects the purpose and intent of the original provision. 20.3. Unless proven otherwise, Steadia's records will serve as the basis for determining the services used by the customer, payments, subscriptions and changes. 20.4. These General Terms and Conditions are drawn up in Dutch. If Steadia also provides a translation, the Dutch version shall prevail in the event of inconsistencies. 20.5. For agreements between Steadia and consumers, mandatory statutory provisions apply. For business customers, Dutch law applies unless otherwise agreed in writing. 21.
